Terms of Service

and Acceptable Use Policy

E Host Solution makes available web hosting and related services subject to our Terms of Service (TOS) and Acceptable Use Policy (AUP) designed to ensure that all Users receive the high level of service they are entitled to.

Acceptable Use Policy
Our Acceptable Use Policy is designed to protect E Host Solution, its Users and others from illegal, malicious, damaging and inappropriate behavior by Users of E Host Solution’s services. Upon payment and account activation, Users agree to be bound by all guidelines outlined in this Acceptable Use Policy.

Refusal of Service:
We reserve the right to refuse, terminate, or suspend service for any reason at our sole discretion. Any content that, in our judgment, violates our Terms of Service or Acceptable Use Policy, in any manner may be removed from our servers (or otherwise disabled), with or without notice.

Content
All services provided by E Host Solution must be used only for lawful purposes and any account that is found to be either questionable or in violation of this policy will be terminated without warning. As a user it is your responsibility to request approval if you have doubt or you are unsure on whether your content is acceptable. E Host Solution does not permit the following on our system:

  • illegal, harmful or fraudulent content or activities
  • sites with hacking content or links to hacking content
  • pornographic material or links to sites with pornographic material
  • improper use of copyrighted material
  • pirated software, warez sites, IRC Bots or daemons

E Host Solution will be the sole arbiter as to what constitutes content violation. All users of our system agree to indemnify and hold E Host Solution guiltless for any judgment or action taken against them due to their actions or content that is placed on our system.

Zero Tolerance Spam Policy
You may not use our Services to send spam or bulk unsolicited messages. E Host Solution has a zero tolerance policy for use of its network or services in any manner associated with the transmission, distribution or delivery of bulk e-mail, including unsolicited bulk or unsolicited commercial e-mail, or the sending, assisting, or commissioning the transmission of commercial e-mail that does not comply with the U.S. CAN-SPAM Act of 2003 (“SPAM”).

Users are responsible for all email accounts and forwarders associated with their account, and for all emails sent through their account. Any account found in violation of our no-tolerance spam policy may be suspended or terminated with or without notice.

Excessive Resource Usage
Customers are required to utilize server resources in an efficient and responsible manner. Excessive use of server CPU, memory or bandwidth resources by a customer can interfere with or prevent normal service performance for other customers. Excessive resource usage examples includes:

  • Generating spikes in network traffic usage that are out of proportion (in volume or frequency) to those typically generated by clients who have purchased similar hosting services
  • Consuming CPU or other processing resources in a manner that is excessive in relation to amount of network traffic typically generated by clients who have purchased similar hosting services.

Accounts found in violation of excessive resource usage may be suspended or terminated with or without notice.

Backup Your Content
Your are responsible for saving and downloading current backups of your web site files and database. E Host Solution is not responsible for file or data loss. If you incur file or data loss, you agree to hold E Host Solution guiltless. Backing up personal data to a hosting account is prohibited. Our Services are designed to host your web site, not serve as a data repository. E Host Solution reserves the right to remove backups from your hosting account.

Payment and Account Termination
Hosting fees are payable annually in advance, however you may terminate your account at any time. Your account renewal date is the date that your account was initially setup. Accounts are automatically renewed for an additional year on your account renewal date, and hosting fees are due on that date. There is no termination fee or penalty for closing your account. To close your account, please complete the Termination Request Form, or Contact Us at least 30 days prior to your account termination date.

Accounts over 15-days past due are subject to suspension (web site and email is frozen), and accounts over 30-days past due are subject to termination (files removed from the server). If your account is terminated for any reason, E Host Solution is under no obligation to save or provide a backup copy of your website. In the event that we have a backup of your website, you are subject to an $85 archive fee to restore your site on our server, or obtain a copy of backup files.

Customer Support
E Host Solution provides multiple types of customer support, including phone support during normal business hours. As a User of our system you agree not to abuse our customer support systems. E Host Solution will be the sole arbiter as to what constitutes a violation of this provision. Customer support does not include installation of third-party software, code debugging, cleaning of hacked sites or customization of software.

Failure To Follow our AUP
Failure to follow any term or condition will be grounds for immediate account termination. No refunds are guaranteed under any circumstances and any refunds given are solely at the discretion of E Host Solution.

No Liability For Account Termination
Neither party will be liable to the other for any termination or expiration of any Service or this Agreement in accordance with its terms.

Finalization of Policies
This agreement supersedes any written, electronic, oral or implied communication you may have had with E Host Solution or any agent or representative thereof, and constitutes the complete and total agreement between the parties. E Host Solution may modify the Terms of Service and Acceptable Use Policy any time without notice.
